Foul Play Sports Bar & Grill ("Foul Play,""we," "us," or "our") operates the websitefoulplaysportsbargrill.com (the "Site") and the restaurant located at1468 Highway 35 Byp. N, Ste G, Alvin, TX 77511. This Privacy Policy explainswhat information we collect when you visit our Site, place an order, join ourmailing list, or interact with our advertising, how we use that information,who we share it with, and the choices available to you.

2. Scope

This policy applies to information collected through the Site,through our email and text message marketing, through our social media pages,and through advertising we run on third-party platforms.

This policy does not apply to information collected offline inthe restaurant except where noted, or to third-party services that operateunder their own privacy policies. When you place an online order, complete apayment, or use a reservation platform, that provider collects and handles yourinformation under its own terms. We identify those providers in Section 6.

3. Information We Collect

3.1 Information youprovide directly

•    Contact information. Name, email address, phonenumber, and mailing address when you subscribe to our newsletter, submit acontact form, or sign up for promotions.

•    Order information. Items ordered, order notes,pickup or delivery preferences, and delivery address.

•    Payment information. Payment card details arecollected and processed by our payment processor. We do not store full cardnumbers on our systems.

•    Reservation and event information. Party size,date, time, special occasion details, and any accommodation requests you tellus about.

•    Employment inquiries. Information you submit ifyou apply for a position with us.

•    Communications. The content of messages you sendus by email, contact form, text message, or social media.

3.2 Information collectedautomatically

When you visit the Site, we and our service providersautomatically collect:

•    IP address and general geographic location derived fromit

•    Browser type, version, and language settings

•    Device type, operating system, and screen resolution

•    Pages viewed, time spent on pages, scroll depth, andnavigation paths

•    Referring website or advertisement that brought you tothe Site

•    Search terms you enter into our on-site menu search

•    Date and time of your visit

•    Cookie identifiers and similar device identifiers

3.3 Information from thirdparties

We may receive information about you from:

•    Advertising platforms, including aggregated campaignperformance and audience data

•    Social media platforms when you interact with our pagesor content

•    Online ordering and reservation partners

•    Analytics providers

4. Cookies and Similar TrackingTechnologies

Cookies are small text files placed on your device. We alsouse similar technologies including pixels, web beacons, local storage, andsoftware development kits. We refer to all of these as "cookies" inthis policy.

We use the following categories:

•    Strictly necessary. Enable core Site functionssuch as page loading, security, and shopping cart persistence. Examples includesession cookies, load balancing, and fraud prevention. These cannot be disabledthrough our Site.

•    Performance and analytics. Help us understandhow visitors find and use the Site so we can improve it. Google Analytics isour main example.

•    Functional. Remember your preferences andsettings, such as language and saved cart contents.

•    Advertising and targeting. Deliver relevant ads,measure ad performance, and build audiences for future campaigns. Google Adsand the Meta Pixel are our examples. These are the cookies that follow youacross sites.

Cookies may be set by us (first party) or by companies we workwith (third party). Some persist after you close your browser; others expirewhen your session ends.

Managing cookies

You can control cookies through your browser settings. Mostbrowsers let you refuse new cookies, delete existing ones, and alert you when acookie is set. Instructions differ by browser and are available in eachbrowser's help documentation.

Blocking cookies may break parts of the Site, including onlineordering.

For advertising cookies specifically, see the opt-out optionsin Section 8.

5. Google Services We Use

We use several Google products. Google acts as our serviceprovider for some of these and as an independent business for others. Google'sown privacy practices are described at policies.google.com/privacy, and itspractices for data collected through partner sites are described atpolicies.google.com/technologies/partner-sites.

Google Tag Manager. A container that manages thetracking tags on our Site. It does not itself collect personal information, butit deploys the tools listed below.

Google Analytics 4. Measures Site traffic and userbehavior. Collects IP address, device and browser data, pages viewed, sessionduration, and events such as menu searches, form submissions, and outboundclicks to our ordering platform. We use this to understand which pages and menuitems draw the most interest.

You can prevent Google Analytics from collecting your data byinstalling the Google Analytics Opt-out Browser Add-on, available attools.google.com/dlpage/gaoptout.

Google Ads and conversion tracking. We advertise onGoogle Search, Google Display Network, and YouTube. Conversion tracking tellsus which ads led to actions such as placing an order or joining our list.

Google Ads remarketing. We use remarketing to show adsto people who have previously visited our Site. This uses cookies to recognizereturning visitors across other websites and apps in the Google network.Third-party vendors, including Google, may show our ads on sites across theinternet and may use first-party cookies (such as the Google Analytics cookie)together with third-party cookies (such as the DoubleClick cookie) to inform,optimize, and serve those ads based on your past visits to our Site.

Customer Match. We may upload hashed email addresses orphone numbers from our customer list to Google in order to show ads to thosecustomers or to exclude them from campaigns. The data is hashed before uploadso Google does not receive your address in readable form.

Google Signals and demographic reporting. Whereenabled, this associates visit data with signed-in Google users who have turnedon Ads Personalization, allowing us to view aggregated demographic and interestreporting. We see only aggregated categories, never individual profiles.

You can opt out of personalized Google advertising at any timeat adssettings.google.com.

6. Meta (Facebook and Instagram) ServicesWe Use

We advertise on Meta platforms and use the following tools.Meta's data policies are at facebook.com/privacy/policy.

Meta Pixel. A snippet of code on our Site that reportsvisitor actions to Meta. It collects your IP address, browser and deviceinformation, the pages you view, and actions such as viewing the menu,initiating an order, or completing a signup. Meta may match this activity toyour Facebook or Instagram account if you have one.

Conversions API. Sends the same event information toMeta from a server rather than from your browser. This improves measurementaccuracy when browser tracking is blocked. Events sent through this channel arededuplicated against Pixel events so actions are not double counted.

Custom Audiences. We may upload hashed contactinformation from our customer or subscriber lists so Meta can show ads to thosepeople, to people who resemble them (Lookalike Audiences), or exclude them fromcampaigns. Contact information is hashed before it reaches Meta.

Website Custom Audiences. We build advertisingaudiences from Site visitors, such as people who viewed the menu but did notorder.

You can control how Meta uses your data for advertising inyour Facebook or Instagram account under Settings, then Ads, then AdPreferences.

7. Other Third-Party Services

•    [ONLINE ORDERING PLATFORM, e.g. Toast].Processes online food orders. Receives your name, contact details, ordercontents, and payment information.

•    [PAYMENT PROCESSOR]. Processes card payments.Receives payment card details, billing information, and the transaction amount.

•    Webflow. Hosts the Site. Receives server logsincluding your IP address, and any form submissions.

•    Mailchimp. Sends our email newsletter andmanages our subscriber list. Receives your name, email address, phone number,and engagement data such as opens and clicks.

•    [RESERVATION PLATFORM, if any]. Managesreservations. Receives your name, contact details, and party details.

•    [SMS PROVIDER, if applicable]. Sends textmessage promotions. Receives your phone number and message engagement data.

Each of these providers operates under its own privacy policy.We recommend reviewing them.

8. How We Use Your Information

We use the information described above to:

•    Take, prepare, and fulfill your food and drink orders

•    Process payments and issue refunds

•    Manage reservations and private event bookings

•    Send you the newsletter, promotions, and eventannouncements you signed up for

•    Respond to your questions, feedback, and complaints

•    Operate, maintain, secure, and improve the Site

•    Understand which menu items, pages, and promotionsperform well

•    Create, target, and measure advertising campaigns

•    Build advertising audiences and exclude existingcustomers where appropriate

•    Detect and prevent fraud, abuse, and security incidents

•    Comply with legal obligations, including those relatingto alcohol service and food safety

•    Enforce our Terms and Conditions

9. How We Share Your Information

We do not sell your personal information for money.

However, our use of advertising cookies may constitute"selling" or "sharing" personal information as those termsare defined under California and certain other state privacy laws, becauseinformation about your visit is disclosed to advertising partners forcross-context behavioral advertising. See Section 11 for how to opt out.

We share information with:

•    Service providers who perform functions on ourbehalf, including hosting, payment processing, online ordering, email delivery,and analytics. They are permitted to use your information only to provide thoseservices.

•    Advertising and analytics partners, as describedin Sections 5 and 6.

•    Professional advisors such as lawyers andaccountants where necessary.

•    Law enforcement or regulators where we arelegally required to do so, or where necessary to protect the rights, property,or safety of Foul Play, our guests, our staff, or the public. This includescooperation with the Texas Alcoholic Beverage Commission and local healthauthorities.

•    A successor entity in the event of a merger,acquisition, financing, or sale of assets.

10. Your Advertising Choices

You can limit interest-based advertising through thefollowing:

•    Google: adssettings.google.com

•    Meta: Ad Preferences in your Facebook orInstagram account settings

•    Network Advertising Initiative:optout.networkadvertising.org

•    Digital Advertising Alliance:optout.aboutads.info or the AppChoices mobile app

•    Your browser: most browsers offer settings toblock third-party cookies

•    Your mobile device: iOS and Android both allowyou to limit ad tracking at the operating system level

Opting out stops personalized ads, not all ads. You will stillsee advertising, it will simply be less relevant.

Global Privacy Control andDo Not Track

Some browsers transmit a Global Privacy Control (GPC) signal.Where required by applicable law, we treat a GPC signal as a valid request toopt out of the sale or sharing of personal information for that browser.

There is no common industry standard for interpreting browser"Do Not Track" signals, and we do not currently respond to them.

11. California Privacy Rights

This section applies to California residents and is providedunder the California Consumer Privacy Act as amended by the California PrivacyRights Act ("CCPA/CPRA").

Categories of personalinformation we collect

In the past twelve months we have collected the followingcategories, as defined by the CCPA:

•    Identifiers, including name, email address,phone number, IP address, and cookie identifiers. Collected from you andautomatically. Used for order fulfillment, marketing, analytics, andadvertising. Disclosed to service providers and advertising partners.

•    Customer records, including name, contactdetails, and payment information. Collected from you. Used for orderfulfillment and payment processing. Disclosed to service providers and ourpayment processor.

•    Commercial information, including orders placedand items purchased. Collected from you and our ordering platform. Used fororder fulfillment, marketing, and analytics. Disclosed to service providers andadvertising partners.

•    Internet activity, including browsing history onour Site, menu search terms, and interactions with our ads. Collectedautomatically. Used for analytics, advertising, and Site improvement. Disclosedto analytics and advertising partners.

•    Approximate geolocation data, derived from yourIP address. Collected automatically. Used for analytics and ad targeting.Disclosed to analytics and advertising partners.

•    Audio, electronic, or visual information,including security camera footage on our premises and photographs taken atevents. Collected on premises. Used for security and marketing. Disclosed tolaw enforcement where required.

•    Professional or employment information,collected only if you apply for a job with us. Collected from you. Used forhiring. Disclosed to service providers.

•    Inferences drawn from the categories above, suchas preferences and characteristics. Derived by us. Used for marketing andadvertising. Disclosed to advertising partners.

We do not knowingly collect sensitive personal information forthe purpose of inferring characteristics about you.

Your rights

If you are a California resident, you have the right to:

•    Know what personal information we havecollected, the sources, the purposes, and the categories of third parties wedisclose it to

•    Access a copy of the specific pieces of personalinformation we hold about you

•    Delete personal information we have collectedfrom you, subject to legal exceptions

•    Correct inaccurate personal information

•    Opt out of the sale or sharing of your personalinformation for cross-context behavioral advertising

•    Limit the use of sensitive personal information,where applicable

•    Non-discrimination, meaning we will not deny yougoods or services, charge different prices, or provide a different quality ofservice because you exercised a right

How to exercise yourrights

Email foulplaysportsbargrill@gmail.com with the subject line"Privacy Request," or call 281-824-4079. We will need to verify youridentity before acting, which usually means confirming information we alreadyhold, such as the email address associated with your subscription or orderhistory.

You may use an authorized agent to submit a request on yourbehalf. We may require proof of authorization.

We will respond within 45 days, and may extend once by afurther 45 days where reasonably necessary, in which case we will tell you.

To opt out of sale or sharing specifically, you can also setyour browser to transmit a Global Privacy Control signal, or adjust cookiesettings as described in Section 4.

Notice of financialincentive

Our newsletter offers subscribers promotional discounts andearly access to events. This may be considered a financial incentive underCalifornia law. The value of the offer to us is reasonably related to the valueof your data to us, which we estimate by reference to the marginal cost of thepromotions offered and the additional revenue generated by subscriber orders.Participation is entirely voluntary, and you may withdraw at any time byunsubscribing using the link in any email.

Shine the Light

California Civil Code Section 1798.83 permits Californiaresidents to request information about disclosure of personal information tothird parties for their direct marketing purposes. We do not disclose personalinformation to third parties for their own direct marketing purposes.

12. Texas Privacy Rights

The Texas Data Privacy and Security Act ("TDPSA")gives Texas residents rights to access, correct, delete, and obtain a portablecopy of their personal data, and to opt out of targeted advertising, the saleof personal data, and certain profiling.

The TDPSA exempts small businesses as defined by the UnitedStates Small Business Administration, except with respect to the sale ofsensitive personal data, which requires consent. We do not sell sensitivepersonal data.

Regardless of whether we are legally required to do so, wewill honor requests from Texas residents on the same basis as those describedin Section 11. Contact foulplaysportsbargrill@gmail.com.

If we deny your request, you may appeal by replying to ourdecision within a reasonable period. If your appeal is denied, you may contactthe Texas Attorney General at texasattorneygeneral.gov.

13. Other State Privacy Rights

Residents of Colorado, Connecticut, Virginia, Utah, Oregon,Montana, and other states with comprehensive privacy laws may have similarrights to access, correct, delete, and port their personal data, and to opt outof targeted advertising and sales. 14. Email and Text Message Marketing

Email. When you subscribe, you consent to receivepromotional emails from us. Every email includes an unsubscribe link, and wehonor unsubscribe requests promptly as required by the CAN-SPAM Act.Unsubscribing from marketing does not stop transactional messages such as orderconfirmations.

Text messages. If you opt in to text messages, messageand data rates may apply. Message frequency varies. Reply STOP to any messageto unsubscribe and HELP for assistance. Consent to receive marketing texts isnot a condition of purchase.

15. Data Retention

We keep personal information only as long as necessary for thepurposes described in this policy, or as required by law.

•    Order and transaction records: retained for at least[NUMBER] years for tax and accounting purposes

•    Newsletter subscriber data: retained until youunsubscribe, then suppressed to prevent re-adding you

•    Analytics data: retained according to the settings ofeach platform, typically 14 months for Google Analytics

•    Security camera footage: retained approximately[NUMBER] days unless preserved for an investigation

•    Employment inquiries: retained for [NUMBER] months

16. Security

We use reasonable administrative, technical, and physicalsafeguards to protect personal information, including encrypted connections onthe Site and restricted access to customer data. No method of transmission orstorage is completely secure, and we cannot guarantee absolute security.

If we become aware of a breach affecting your personalinformation, we will notify you and any required authorities as the lawrequires.

17. Children's Privacy

The Site is not directed to children under 13, and we do notknowingly collect personal information from them. If you believe a child under13 has provided us with personal information, contactfoulplaysportsbargrill@gmail.com and we will delete it.

We serve guests of all ages in the restaurant, including achildren's menu, but online ordering and marketing signups are intended foradults.

18. Third-Party Links

The Site links to third-party services including our onlineordering platform, social media pages, and map services. We are not responsiblefor the privacy practices of those services. Review their policies beforeproviding information.

19. Changes to This Policy

We may update this Privacy Policy from time to time. When wedo, we will revise the "Last Updated" date at the top. Materialchanges will be communicated more prominently, such as by a notice on the Siteor an email to subscribers. Your continued use of the Site after changes takeeffect means you accept the updated policy.
